undefinedAlthough health & safety law is applicable to all UK businesses, if you employ five or more people (including Directors and part time staff), you must produce written records of your health and safety arrangements. These must include:

  • A documented health and safety policy
  • Documented risk assessments for all significant hazards
  • Access to competent health & safety advice
  • Documented arrangements for the planning, organisation, control, monitoring and review of health & safety arrangements
  • Provision of adequate health and safety information, instruction and training

 

As an employer you should ask yourself:

What am I doing to protect the health and safety of my workforce?

Can I be sure that I haven't overlooked anything? 

How can I demonstrate that I have adequately assessed the risks if I have nothing documented?

The penalties for not complying with health & safety law can be very serious:

  • Unlimited fines based on company turnover and/or jail sentences
  • Director disqualification
  • Publicity of formal notices and prosecutions, leading to damaged reputation and loss of business
  • Fee for fault, paying over £100 per hour to the HSE if they visit you and take any action (such as providing an advisory letter)

In the majority of cases an initial inspection / audit will be required in order to obtain the following information:

  • The extent of your business activities
  • The layout and condition of your premises
  • Your day to day practices
  • Your current health & safety arrangements (including maintenance records, documentation etc.)

Without this it is not possible to provide you with honest advice on your current level of compliance, let alone provide you additional advice and guidance. It stands to reason that if you are being offered advice without a visit to your premises, you are unlikely to be compliant with health and safety legislation as a result.
